For estate and probate attorneys

Estates often turn on a house: an heir who wants to keep it, siblings who need to be paid out, or a trust that has to buy or refinance. I find the financing that lets the plan or the settlement work.

How I help your clients

  • Heirs who keep the home. A relative who inherits can often keep the existing mortgage under federal law, or refinance it into their own name.
  • Buying out other heirs. One heir refinances or takes a new loan to pay the others their share, so the house doesn’t have to be sold.
  • Trust purchases and refinances, including loans to a living trust on many loan types.
  • Reverse mortgage estates. Heirs have time to sell or refinance the home, and on a federally insured reverse mortgage they never owe more than the home is worth.
  • Cash for estate costs or a quick sale, with cash-out refinances and bridge loans once title has passed.

Questions

Can an heir keep the existing mortgage?

Often, yes. Federal law generally lets a relative who inherits the home keep the existing loan; the heir works with the servicer to take it over, and can refinance later if that suits them better.

How does a buyout of other heirs work?

The heir who keeps the home takes a new loan, usually a cash-out refinance once title is in their name, and the proceeds pay the other heirs their share.

When can a loan be made on an inherited property?

Usually once title has passed to the heir or the trust. I can review the timeline with you before then, so financing is ready when the court or the trustee is.
